1. Agreement to Terms
By creating an account on Hookset (“the Platform”), operated by Hookset Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
These terms govern the relationship between Hookset and lodge operators (“Lodges”) who use the Platform to manage bookings, guests, and guides. Guests accessing trip preparation forms through token links are subject to a separate, simplified terms notice presented at the time of access.
2. Data Ownership
You retain full ownership of all data you upload or create on the Platform, including guest records, booking information, guide profiles, and communications. Hookset does not claim any ownership over your operational data.
You may export your data at any time from the Settings page. We will provide a machine-readable export (CSV or JSON) of all your lodge's data within 48 hours of request. If you close your account, your data will be retained for 90 days, after which it will be permanently deleted unless you request an export first.
3. Subscription and Billing
Hookset offers subscription plans billed monthly or annually. Pricing is listed on the Pricing page and may change with 30 days' notice. Subscriptions auto-renew unless cancelled before the renewal date.
Transaction fees charged by Stripe on payments processed through the Platform are non-refundable once processed, regardless of booking cancellation. These fees are set by Stripe and governed separately by Stripe's terms.
If you downgrade your plan or cancel your subscription, your access continues until the end of the current billing period. No prorated refunds are issued for partial billing periods.
4. Payment Processing
Payment processing on the Platform is provided by Stripe, Inc. By using Stripe-powered features, you agree to Stripe's Services Agreement and Privacy Policy. Hookset is not a party to payment transactions between lodges and their guests.
Hookset is not responsible for disputes, chargebacks, or refund obligations arising between a lodge and its guests. Lodge operators are solely responsible for honoring their own cancellation and refund policies.
5. Lodge Responsibilities
As a lodge operator, you are responsible for the accuracy of information provided to guests, including trip descriptions, pricing, availability, and cancellation policies. You agree to use the Platform in compliance with all applicable laws, including those governing data privacy, consumer protection, and financial transactions.
You must not use the Platform to store information you are not legally permitted to collect, to send unsolicited communications, or to engage in fraudulent activity.
6. Platform Availability
We aim for high availability but do not guarantee uninterrupted access to the Platform. Scheduled maintenance will be announced in advance where possible. We are not liable for losses arising from Platform downtime, data access delays, or service interruptions.
7. Limitation of Liability
To the maximum extent permitted by law, Hookset's liability for any claim arising from your use of the Platform is limited to the amount you paid in subscription fees in the three months preceding the claim. Hookset is not liable for indirect, incidental, or consequential damages, including lost revenue or guest disputes.
8. Changes to Terms
We may update these terms from time to time. Material changes will be communicated by email with at least 14 days' notice. Continued use of the Platform after the effective date constitutes acceptance of the revised terms.
